GENERAL TERMS:
✤ By commissioning me, you acknowledge that I am a digital illustrator and have accept all the terms of my services.
✤ I reserve the right to reject any order for whatever reason it may be.
✤ Commissions may be chosen based on conditional circumstances and personal preference.
✤ All finished commissioned artwork will be sent with and without a watermark in full resolution. If you repost the artwork somewhere else, please credit and source me, the artist.
✤ The commissioned art I create cannot be used for NFT nor AI training. Breaking this will result in immediately blacklisting.
✤ Commercial work will have a one-time charge fee of 100%.
~~~~~~~~~~PROCESS & DELIVERY:
✤ Once I have confirmed your commission order and receive full payment, I will start with the sketch. The sketch must be approved before I continue forward with art.
✤ Progress update will be given with watermark and low-res quality.
✤ It usually takes about 5 days to 1 month to finish one individual commission, depending on the type of commission and complexity of the art.
✤ If anything comes up that will slow the progress of the initially estimated delivery time I will let you know asap.
~~~~~~~~~~REVISIONS:
✤ You may have up to three revisions
✤ An additional 10% fee will be charged if you go over the limit of your revisions.
✤ An additional 30% fee will be charged if you want any drastic changes halfway through the end of the WIP art.
~~~~~~~~~~PAYMENT:
✤ Full payment upfront in USD through Paypal only.
✤ Prices will differ depending on the number of details and extras.
✤ Once your commission is accepted, I will send a confirmation message and an invoice.
✤ I will only start on your commission once I receive payment in full.
✤ Do NOT pay me if I have not yet accepted your commission order.
✤ Backing out BEFORE payment will not yield in blacklisting, as long as you communicate with me.
~~~~~~~~~~CANCELLATION AND REFUND POLICY:
✤ No refunds can be made after accepting your commission order.
✤ The buyer is not allowed a refund once I start working on the commission.
✤ If for any reason, I am unable to finish your commission, you will receive a full refund.
✤ If you are getting a refund, do not request chargeback. I will transfer the money back to you myself.
✤ If you requested a chargeback at any point when you were not allowed to ask for a refund you will lose all the aforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and you will be blacklisted from commissioning me again.
✤ I reserve the right to stop working on a commission or cancel a commission request due to poor communication, rude, or inappropriate behavior.
~~~~~~~~~~COPYRIGHT USAGE:I, Maifu Arts (the artist):
✤ I will retain all copyrights over the commissioned artwork.
✤ I reserve the right to post the commissioned artwork online, use it for self-promotion, put it in my portfolio, etc.
✤ I will NOT claim the commissioner’s intellectual property (IP) of their characters who are requested to be drawn.
✤ I will NOT profit further from the commissioned artwork unless you (the customer) break any of the terms.
You (the client/commissioner):
✤ You may upload the commissioned artwork on any website and social media while giving me (the artist) credit.
✤ You may NOT alter the commissioned artwork without my (the artist's) consent.
✤ You retain the rights to the intellectual property (IP).
✤ Personal commissioners may NOT make profits from the commissioned piece (reselling, redistributing, uploading to POD services, making prints, etc.)
✤ Personal commissioners may NOT use the commissioned artwork for commercial purposes = you are NOT allowed to sell, redraw, edit, make merchandise, claim credit, or use my artwork for advertising.
✤ Personal commissioners are free to use the artwork for personal websites, blogs, avatars, etc. with credit and source, as long as the image is not used commercially.
✤ Commercial commissioners may use the art for derivative content such as advertisement, graphics, promotions, stream assets, cover art, etc. or any usage that could earn revenue that is counted as commercial.
The following is considered copyright infringement:
✤ Reproducing/using the copyrighted artwork commercially - means making money off it in any way not excluded from these terms.
✤ Claiming the artwork as your own
✤ Altering the artwork without my consent
✤ In some cases, the commercial rights to the image may be purchased.
